Legal Notice & Accessibility Statement

1. Company Information

This website is operated by Elm Dirt, LLC, a Missouri limited liability company headquartered in Grandview, Missouri. For questions regarding this notice, please contact us:

Website: www.elmdirt.com

2. Product Claims & Results Disclaimer

Elm Dirt products are designed to support healthy soil biology and plant nutrition. However, individual results will vary. Factors including soil type, climate, existing soil conditions, watering practices, plant variety, and application method all affect outcomes.

Any testimonials, reviews, before-and-after descriptions, yield improvements, or growth claims displayed on this website reflect the experiences of individual customers and are not guarantees of results. Your experience may differ.

Nothing on this website is intended to constitute a guarantee of specific plant growth, crop yield, pest control, or disease prevention outcomes.

3. Certification & Organic Labeling Clarification

Elm Dirt uses the following certifications. We want to be transparent about exactly what each means:

  • CDFA Certified Organic — Plant Juice is certified organic by the California Department of Food and Agriculture (CDFA). This is a fertilizer-specific organic certification issued under the California Food and Agriculture Code. It is not the same as USDA Certified Organic, which applies to food and agricultural products under the National Organic Program (NOP). CDFA Certified Organic fertilizers are approved for use in USDA Certified Organic food production.
  • Class A Certified Compost — Ancient Soil worm castings hold Class A compost certification, meaning they meet EPA Part 503 standards for pathogen reduction and vector attraction, and have been third-party tested for heavy metals below EPA limits.

Elm Dirt does not claim any product is "USDA Certified Organic" unless explicitly and specifically stated for that individual product. Use of the word "organic" on this site refers to naturally derived, biologically active ingredients and/or the certifications described above.

4. Third-Party Laboratory Data Disclaimer

Microbial species counts, functional statistics, and biological activity data referenced on this website are derived from third-party microbiome analysis reports conducted by BiomeMakers, Inc. (Reports CUX005 and CUX004).

These results:

  • Reflect the specific product samples submitted for testing at the time of analysis
  • Represent the potential functional activity of identified microbial species based on genomic characterization — not guaranteed outcomes in any specific soil environment
  • Are shared for informational and research purposes only, as specified in the BiomeMakers report terms
  • Are not a substitute for professional agronomic advice

Living biological products contain naturally variable microbial communities. Batch-to-batch microbial composition may vary. BiomeMakers, Inc. accepts no responsibility for results derived from the application of information in its reports, and neither does Elm Dirt as it pertains to lab interpretation.

5. Not a Substitute for Professional Advice

The information on this website — including blog posts, product descriptions, application guides, and social media content — is provided for general educational purposes only. It is not intended to replace advice from a qualified agronomist, horticulturist, licensed pesticide applicator, or medical professional.

Before making significant changes to your soil management, crop production program, or agricultural operations, consult with a qualified professional familiar with your specific conditions.

Elm Dirt products are fertilizers and soil amendments. They are not pesticides, herbicides, or medical products, and no claims on this site should be interpreted as such.

6. Health & Safety

Elm Dirt products are formulated to minimize the use of synthetic chemicals. However, no product claim on this site is intended to constitute a medical health claim or imply that our products prevent, treat, or cure any human or animal health condition.

Always follow label instructions. Keep products out of reach of children and pets except as directed. Review the Safety Data Sheet (SDS) for each product before use in commercial or large-scale applications. SDS documents are available upon request at support@elmdirt.com.

  • The use or misuse of our products
  • Reliance on information published on this website
  • Any interruption, error, or omission in website content

Our total liability to any customer shall not exceed the amount paid for the specific product giving rise to the claim.

Any legal action shall be brought exclusively in the state or federal courts located in Jackson County, Missouri.

10. Accessibility Statement

Our Commitment

Elm Dirt, LLC is committed to ensuring that our website is accessible to all users, including people with disabilities. We believe that everyone deserves equal access to information about our products and the ability to shop with us comfortably.

We strive to conform to the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA standards published by the World Wide Web Consortium (W3C), which are widely recognized as the benchmark for web accessibility and referenced by the U.S. Department of Justice as the standard for ADA compliance.

What We're Doing

Our ongoing accessibility efforts include:

  • Using descriptive alt text on product images and photography
  • Maintaining sufficient color contrast throughout our site design
  • Structuring pages with proper heading hierarchy (H1, H2, H3) for screen reader navigation
  • Providing text alternatives for non-text content
  • Ensuring all forms and interactive elements are keyboard-navigable
  • Writing link text that is descriptive and meaningful out of context
  • Avoiding content that flashes or strobes in ways known to cause seizures
  • Using semantic HTML to communicate page structure to assistive technologies
  • Conducting periodic accessibility reviews and remediating identified issues promptly

Assistive Technology Compatibility

Our website is designed to be compatible with the following assistive technologies:

  • Screen readers (including NVDA, JAWS, VoiceOver, and TalkBack)
  • Keyboard-only navigation
  • Browser zoom up to 200% without loss of content or functionality
  • High contrast display modes

Known Limitations

While we work continuously to improve accessibility, some third-party content, embedded applications, or legacy content may not yet fully meet WCAG 2.1 AA standards. We are actively working to identify and remediate these issues on an ongoing basis. We do not consider this website to be fully complete with respect to accessibility — we treat it as a continuous improvement effort, not a one-time fix.

Accessibility Feedback & Cure Process

If you encounter any barrier on our website that prevents you from accessing our content or completing a purchase, please contact us before taking any other action. We take accessibility complaints seriously and are committed to resolving confirmed issues quickly.

How to reach us:

Subject line: "Accessibility Issue"

What to include in your message:

  • The specific page URL where you encountered the issue
  • A description of what you were trying to do
  • The assistive technology or browser you were using (if known)

Our committed response timeline:

  • Within 1 business day: We will acknowledge receipt of your complaint in writing
  • Within 5 business days: We will assess the reported issue and provide a written response describing our findings and intended remediation plan
  • Within 30 days: We will remediate any confirmed WCAG 2.1 AA violation or provide a written explanation of why remediation is not technically feasible and what alternative accommodation we can offer

We maintain a written log of all accessibility complaints received, our responses, and the remediation actions taken. This log is available to demonstrate our good-faith compliance efforts.

We believe that direct communication is almost always faster and more effective than any other process. The vast majority of accessibility issues can be identified and fixed within days when we know about them. Please give us the opportunity to make it right.

Formal Complaints

If you contact us about an accessibility issue and are not satisfied with our response after allowing us the cure period described above, you may contact the U.S. Department of Justice Civil Rights Division or your regional ADA National Network center for further assistance.

We respectfully note that we cannot remediate issues we are not aware of. We ask that any party asserting an accessibility claim first provide written notice to the contact above and allow us the opportunity to cure before pursuing any legal or administrative remedy.

11. Updates to This Notice

We may update this Legal Notice and Accessibility Statement periodically to reflect changes in our practices, products, or applicable law. The "Last updated" date at the top of this page indicates when the most recent revision was made.
